The SEC had already taken the hint from a 2018 case that the Supreme Court wasn't thrilled with in-house judges and cases and brought its most serious types of fraud cases to the courts, says James Tierney, assistant professor at Chicago-Kent College of Law and a former staff attorney for the agency. 鈥淭he SEC doesn't have infinite resources, and so if the cost of settlement goes up, it means they're going to have fewer resources to bring enforcement actions,鈥 Tierney says.

鈥淭his is a court that claims to be an originalist court and, if nothing else, these opinions establish that originalism is not a straightforward approach and does not lead to greater certainty, despite the claims that originalists make,鈥 said Carolyn Shapiro, the founder of Chicago-Kent College of Law's Institute on the Supreme Court of the United States. Originalism 鈥渃an lead to different results depending on who is doing the analysis," she said, continuing: 鈥淚t just simply does not provide the certainty that originalists claim.鈥
鈥淭here鈥檚 a limited amount you can do,鈥 said attorney Katherine Baker, who teaches contract law at Chicago-Kent College of Law. 鈥淚t is not the responsibility of the receiver to figure out where this came from. It's definitely not their responsibility to load up their car and bring all of this stuff to FedEx or UPS.鈥 Since the family has made some effort to reach the person to whom the packages are supposed to be going, Baker said, 鈥渁t some point, they can just discard it.鈥
Companies can choose when to use these warnings, which vary widely. For example, a 2017 survey conducted by the FDA and the Illinois Institute of Technology of 78 dark chocolate products found that almost two-thirds contained an advisory statement for peanuts; of those, only about four actually contained the allergen. Meanwhile, of 18 bars that carried no advisory statement for peanuts specifically, three contained the allergen.

Once you start thinking about computation, you start to see it everywhere. Take mailing a letter through the postal service. Put the letter in an envelope with an address and a stamp on it, and stick it in a mailbox, and somehow it will end up in the recipient鈥檚 mailbox. This routing process is not unlike what happens with electronic mail or any other piece of data sent through the internet.
